Project 3 - Market Power and its Regulation
From Article 102TFEU flows a number of specific rules governing practices which dominant firms may not engage in, but are lawful for other firms in the market. The state of the law and enforcement practice under Article 102 has been recently reviewed by the European Commission, although there is a continuing debate in both academic and policy circles as to what are the appropriate limits of the prohibition and its underpinning principles. The broad questions to be addressed in this theme, approached from a number of different disciplinary perspectives, and employing diverse methodologies, are:
- What is the role of fairness in Article 102?
- How is, and should, price discrimination be dealt with?
- How should vertical practices and restraints be approached, especially given the recent changes to the VBER?
- How does competition policy interact with sector regulation?
